There are several forms required for marriage dissolution in Ohio.
In the state of Ohio, dissolution of marriage is based on no fault grounds, such as incompatibility or irreconcilable differences. Generally, the legal action of dissolution in Ohio involves an agreement between the two married parties coming to a uniform conclusion that the marriage should come to an end. Decisions about normally contested divorce issues like divide assets, guardianship of children, and child and spousal support are agreed upon by both parties beforehand. There are several court forms to submit as part of the Ohio Dissolution of Marriage.
Petition and Waiver of Service
The Petition and Waiver of Service is the first of the forms. It is a declaration of the parties involved, and basic identifying information, such as Social Security numbers and birth dates. It is also an acknowledgement of required circumstances for marriage dissolution in Ohio. Statements are made confirming: the Ohio residency status of at least one of the petitioners; the location the couple was married; and that both persons voluntarily wish to dissolve the marriage. This form is one page long.
Separation Agreement
The separation agreement describes to the court how both parties have already separated their lives. It goes into detail about how their lives and property will be separated upon dissolution of the marriage. Savings accounts, checking accounts, household items, motor vehicles, and spousal support are among the matters detailed in this four-page form. It is also noted when this agreement will go into effect.
Decree of Dissolution of Marriage
In the two-page Decree of Dissolution of Marriage, the court reviews the testimony of both petitioners. This is signed by a court referee and the judge, and notarized by the deputy clerk. It is on this form that the wife underscores whether she will return to using her maiden name.
Waiver of Representation
Two separate one-page forms are acknowledgements by each party that he and she could have obtained counsel (an attorney), but have decided not to be represented. Both acknowledge that they have indeed waived their rights to be represented by counsel in the marriage dissolution proceedings.
Waiver of 14-Day Objection Period
On this form, both parties sign to agree that they will waive the usual 14-day objection period that would allow them to object to the arrangements made within the separation agreement or otherwise, and the agreement takes effect upon docketing. This is a one-page form.
Waiver of Property
On the Waiver of Property form, both parties agree that they cannot return to the court requesting new divisions of property based upon a new appraisal they have received, or otherwise object to the arrangements set forth in the division of property within the separation agreement. The parties must agree that, while the division of property may not be equal, it is indeed equitable. This is a one-page form.
Waiver of Financial Documentation
Like the Waiver of Property, on the Waiver of Financial Documentation, both parties must wave any right to object to the financial documentation as part of this marriage dissolution, or submit to the court for an independent review. This is a one-page form.
Financial Disclosure Affidavit
In the Financial Disclosure Affidavit, both parties must attest to the court that the financial assets and property they have detailed in the course of this agreement are indeed true. In Franklin County, Ohio, an additional form called Assets and Liabilities is required. This is a one-page form.
